Overstaying a visa or residence permit in Turkey: what happens if you overstay

Published:

On this page

In short

  • A visa or visa exemption allows at most 90 days in Turkey in any 180 days; a longer stay requires a residence permit.
  • Overstaying a visa or visa exemption, or a residence permit without an acceptable reason, by more than ten days is a ground for a deportation decision.
  • Unpaid overstay amounts lead to the refusal of later residence permit applications.
  • Leaving on your own before a deportation decision and paying what is owed allows the authority not to impose an entry ban, or limits a ban to one year.

Staying in Turkey beyond what your visa, visa exemption or residence permit allows has consequences that depend mainly on how long the overstay lasts and on how you leave. This page sets out what Law No. 6458 and the Regulation on the Implementation of the Law on Foreigners and International Protection (the YUKK Regulation) say about it.

Count your days: the 90/180 rule

Enter the dates of your stays to see how many days you have spent in Turkey in the 180 days ending on the date you choose, and on how many days of your stays you were over the limit, that is, the 180 days ending on that day contained more than 90 days in Turkey. The counter counts the day of entry and the day of exit as days in Turkey, counts a day on which you left and re-entered only once, and assumes that the 180 days are counted back from each day it checks. The Law does not say how days are counted or from when the 180 days run, so the result is an estimate, not an official calculation. It does not tell you whether you have overstayed by more than ten days.

Stay 1

Leave empty if you are still in Turkey.

The day you want to check, such as today or a planned exit date. The 180-day period ends on this day.

The dates you enter are processed only in your browser. They are not sent to us or anyone else and are not stored.

What is the 90/180 rule, and where is it written?

If you come to Turkey on a visa or under a visa exemption, the stay it allows cannot exceed 90 days in every 180 days (Law No. 6458, art. 11(1)). The YUKK Regulation repeats the rule word for word (YUKK Regulation art. 10(1)).

Which nationalities are exempt from the visa requirement is decided by treaties to which Turkey is a party or by Presidential decision (Law No. 6458, art. 12(1)(a)). This page does not list countries or the length of each exemption.

The rule does not apply to people who hold a valid residence or work permit in Turkey (YUKK Regulation art. 10(2)(a)). Anyone who will stay longer than the visa or exemption allows, or longer than 90 days, must obtain a residence permit (Law No. 6458, art. 19(1)).

The Law and the Regulation do not say how the days are counted. They do not state whether the day of entry and the day of exit each count as a day in Turkey, or from which date the 180 days are measured.

When does a stay become an overstay?

A visitor who comes on a visa or visa exemption of up to 90 days is exempt from the residence permit requirement only for the duration of that visa or exemption (Law No. 6458, art. 20(1)(a)).

A residence permit holder must apply for an extension starting 60 days before the permit expires, and in any case before it expires (YUKK Regulation art. 21(5)).

Applications made in Turkey are still accepted from people who have exceeded their residence permit, visa or visa exemption by up to ten days (YUKK Regulation art. 21(2)). After that, the Regulation allows the ten-day condition to be set aside only where the person's situation or administrative needs require it.

If an extension is not granted or a residence permit application is refused, you are given a document that allows you to stay in Turkey for up to ten days (YUKK Regulation art. 22(11)). Refusals are covered on a separate page.

Do I have to pay a fine or a fee for overstaying?

Law No. 6458 art. 102, which lists the administrative fines under the Law, does not name overstaying a visa or residence permit as such. The fine it sets for people who have been given time to leave is for not leaving within that period (art. 102(1)(c)). Art. 102(6) also allows a fine for breaching obligations set in regulations issued by the Ministry under the Law; the Law does not say whether this is applied to overstays.

The Law and the YUKK Regulation refer to the visa and residence fees for the overstay and the penalties attached to those fees, and in places to administrative fines (Law No. 6458, art. 9(4)) or fines arising from the visa or residence violation (YUKK Regulation art. 58(7)). The exit permit given to people invited to leave does not affect the obligations relating to these fees and penalties (Law No. 6458, art. 56(2)), and the YUKK Regulation makes the lighter entry ban rules conditional on paying them (YUKK Regulation art. 8(2)(b) and (c)). Neither text sets the amount.

Where an application is taken after the ten-day period because the person's situation or administrative needs require it, and is granted, the new permit runs from the application date, and the fee for the time spent until that date is calculated under the Fees Law (No. 492) (YUKK Regulation art. 21(3)).

Unpaid amounts have later effects. A residence permit application is refused if debts arising from a visa overstay or a previous residence permit have not been paid (YUKK Regulation art. 22(10)), and a visa is not issued to someone who does not agree to pay them (Law No. 6458, art. 15(1)(ğ)). Governorships (valilik) may also make a foreigner's admission to Turkey subject to prior permission because of administrative fines and public receivables (Law No. 6458, art. 9(7)).

What happens when I leave Turkey after an overstay?

No deportation decision is taken against people who have exceeded a visa or visa exemption by more than ten days and come to a border gate on their own to leave (YUKK Regulation art. 52(1)(b)). The same applies to residence permit holders who have exceeded their permit by more than ten days without an acceptable reason, and to people whose extension was refused and who did not leave within ten days, if they come to the border on their own to leave (art. 52(1)(ç) and (d)).

For people who come to the border on their own before a deportation decision is taken, the authority may decide not to impose an entry ban on grounds of the visa or residence violation, provided the fees arising from the violation and the penalties attached to them have been paid. This does not apply where another ground for an entry ban exists (YUKK Regulation art. 8(2)(c)).

If you instead apply to the governorship to leave Turkey before a deportation decision is taken or served on you, any entry ban cannot exceed one year, again provided those fees and penalties have been paid and no other ground for a ban exists (YUKK Regulation art. 8(2)(b)). The Law adds that, where such an application is made before the overstay is detected by the authorities and is followed by a deportation decision, the authority may decide not to impose an entry ban at all, provided the administrative fines have been paid and the violation periods set by the Ministry have not been exceeded (Law No. 6458, art. 9(4)).

When can an overstay lead to deportation?

A deportation decision is taken against people who exceed a visa or visa exemption by more than ten days, and against residence permit holders who exceed their permit by more than ten days without an acceptable reason (Law No. 6458, art. 54(1)(e) and (g)). The same applies to people whose extension application is refused and who do not leave Turkey within ten days (art. 54(1)(j)).

A deportation decision gives a period of not less than 15 days and up to 30 days to leave Turkey. The period is not given in some cases, including where there is a risk of absconding or where the rules on legal entry or exit have been breached (Law No. 6458, art. 56(1)).

The Law allows the authority not to impose an entry ban on people invited to leave who leave within that period (Law No. 6458, art. 9(5)). The YUKK Regulation states that no ban is applied to those who reach the border within the period and pay any fines arising from the visa or residence violation, and that people who arrive after the period has ended receive an entry ban according to the length of the violation (YUKK Regulation art. 58(7) and (8)).

People who do not leave within that period without an acceptable excuse are placed under administrative detention by the governorship (YUKK Regulation art. 58(2)), and an administrative fine applies for not leaving within the period (Law No. 6458, art. 102(1)(c)).

A deportation decision can be challenged before the administrative court within seven days of its service (Law No. 6458, art. 53(3)). How to challenge a deportation decision is covered on a separate page.

How long can an entry ban last after an overstay?

Foreigners who are deported from Turkey are banned from entering by the Presidency of Migration Management (Göç İdaresi Başkanlığı) or the governorship (Law No. 6458, art. 9(2)). The Law's definitions still call this authority the Directorate General of Migration Management (art. 3(1)(ğ)), while later amended provisions use the name Presidency (for example art. 121/A). An entry ban lasts at most five years; where there is a serious threat to public order or public security, the Presidency can extend it by up to ten years more (art. 9(3)).

For overstays, the Law allows the authority not to impose an entry ban on people whose visa or residence permit has expired, who apply to the governorship to leave Turkey before this is detected by the authorities and receive a deportation decision, provided they have paid the administrative fines and have not exceeded the violation periods set by the Ministry (Law No. 6458, art. 9(4)).

Those violation periods are not listed in the Law or the Regulation, so this page does not give ban lengths by length of overstay.

The Presidency can lift an entry ban, or allow entry for a set period while keeping the ban in place (Law No. 6458, art. 9(6)). Lifting a ban is covered on the entry ban page.

Frequently asked questions

Is the 90/180 rule actually in Turkish law?

Yes. Law No. 6458 art. 11(1) provides that the stay allowed by a visa or visa exemption cannot exceed 90 days in every 180 days. The YUKK Regulation repeats the rule in art. 10(1).

Does the 90/180 rule apply if I have a residence permit?

No. The YUKK Regulation excludes people who hold a valid residence or work permit in Turkey, among others, from the rule (art. 10(2)(a)).

How are the 90 days counted?

The Law and the YUKK Regulation set the limit but do not say how the days are counted, for example whether the day of entry and the day of exit count, or from which date the 180 days run. The counter on this page counts both days, counts a day on which you left and re-entered only once, and uses a 180-day period ending on each day it checks, so its result is an estimate, not an official calculation.

Is an overstay of a few days treated differently?

The ten-day mark matters. Residence permit applications are still accepted from people who have overstayed by up to ten days (YUKK Regulation art. 21(2)), and the deportation grounds for overstaying cover overstays of more than ten days (Law No. 6458, art. 54(1)(e) and (g)). The counter on this page does not tell you whether you have overstayed by more than ten days.

Will I be fined when I leave?

Law No. 6458 art. 102 does not list overstaying as a separate fine. Art. 102(6) allows a fine for breaching obligations set in the Ministry's regulations under the Law, but the Law does not say whether this is applied to overstays. The texts nevertheless refer to amounts arising from an overstay: the visa and residence fees and the penalties attached to them, and administrative fines or fines arising from the violation (Law No. 6458, art. 9(4); YUKK Regulation art. 58(7)). Paying them is a condition for the lighter entry ban rules. Neither text sets the amount.

Can I come back to Turkey after an overstay?

That depends on whether an entry ban was imposed. If, before any deportation decision, you came to the border on your own and paid the fees arising from the overstay and the penalties attached to them, the YUKK Regulation allows the authority not to impose a ban for the overstay. If you instead applied to the governorship to leave before a deportation decision was taken or served on you, and paid those amounts, a ban cannot exceed one year. Where that application was made before the overstay was detected and the violation periods set by the Ministry were not exceeded, the Law allows the authority not to impose a ban at all once the administrative fines are paid. A ban after deportation can last up to five years, and longer where there is a serious threat to public order or public security.

Can I apply for a residence permit after overstaying?

Applications made in Turkey are accepted from people who have overstayed by up to ten days (YUKK Regulation art. 21(2)). A residence permit application is refused if debts arising from a visa overstay or a previous residence permit have not been paid (YUKK Regulation art. 22(10)).
